2. Application of the general conditions of sale
The order by the Customer implies acceptance of all of these general conditions.
3. Validity of offers
Our offers are aimed at consumers over 18 years old. If you are under 18 years of age, you are prohibited from using the SHIFTERS.CH website, as well as its products and services. The items visible on the site are available while stocks last. The validity period of the offers and the price is guaranteed within 8 days.
In the event of debit or collection for the order of an unavailable item, SHIFTERS.CH undertakes to offer a credit or reimburse the customer within 30 days. SHIFTERS.CH undertakes to notify by email the customer who has placed an order for an unavailable item.
Product presentation
The products offered for sale are those described on the site. The company SHIFTERS Lausanne takes the greatest care in the presentation and description of its products to best satisfy the customer's information. However, it is possible that non-substantial errors may appear on the site, which the customer acknowledges and accepts.
In any case, in the event of non-compliance of the product delivered with its description on the site, the customer may either exercise his right of withdrawal or implement the guarantee of conformity of the company SHIFTERS Lausanne which will proceed , where applicable, either for exchange or reimbursement of the price (in whole or in part) possibly invoiced.
5. Product prices
Prices are invoiced inclusive of tax (including Swiss VAT 7.7%). We reserve the right to change our prices at any time, without prior notice, but products are invoiced at the price at the time of the purchase order.
6.1: Payment
The customer validates his order as stated below. This validation entails acceptance of these general conditions of sale. The customer interested in an item visible on the SHIFTERS.CH site follows the following process to place their order. After clicking on the “confirm” icon and after checking the specifics of his order (color, quantity, product, price, etc.), the customer validates the choice of the selected product(s) with a click. If the customer benefits from a special offer, he must first enter a code assigned to him in the field provided for this purpose. When placing their first order, the customer has a form to fill out containing the following information: title, surname, first name, full delivery address, email, date of birth, telephone number. On this occasion the customer creates his password. The customer has the option of paying by credit card directly on the site. After having validated his payment method, the customer definitively and irrevocably validates his order with the effects indicated below.
Payment by credit card on the site: The customer validates their delivery and billing address, the product and the total price. He provides his bank card number associated with the expiration date and the CVX code. He finally validates his order by clicking on the “Confirm” button.
6.2: Failure to pay
SHIFTERS Lausanne reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is being administered.
6.3: Verification of payments
SHIFTERS Lausanne controls all orders that have been validated on its site. These controls aim to protect SHIFTERS Lausanne from abusive practices carried out by fraudsters. Our services may ask you for all the documents necessary to release your order: proof of address or debit in your name, or proof of address in the name of the person indicated for the delivery address, etc. These requests will be made by email: - For an order which presents a delivery address different from the billing address - For new customers - For an order greater than 150 Euros.
7. Payment security
In order to ensure the security of payments, the SHIFTERS.CH site uses the secure payment service of the Post Office. This service integrates the SSL security standard. The confidential data (the 16-digit bank card number as well as the expiration date, the CVX code) are directly transmitted encrypted to the post office server without passing through the physical media of the SHIFTERS.CH server.
When the order is validated: The payment request is routed in real time to the secure electronic payment manager. This sends an authorization request to the bank card network. The electronic payment manager issues an electronic certificate which will serve as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the civil code.
You can also make secure transactions from Paypal, Swiss Post and by bank transfer.
8. Identification
The customer who has already made a purchase on the SHIFTERS.CH site can choose a password allowing him, during subsequent orders, to not have to fill out the forms prior to placing the order again. The customer already registered is recognized on the site as being a customer of SHIFTERS.CH. The password enjoyed by the SHIFTERS.CH customer is strictly confidential and personal. Under no circumstances should it be disclosed or communicated to anyone.
In the event that the SHIFTERS.CH customer loses or forgets his password, it is his responsibility to notify the SHIFTERS.CH site manager very quickly at the address shifterslausanne@shifters.ch who will deliver it within 48 hours a new password which will automatically replace the old one. In order to facilitate the identification of the customer by the simultaneous provision of the e-mail address and the password, the customer expressly authorizes SHIFTERS.CH to place on the customer's hard drive a file called "cookie" whose sole purpose is to facilitate said identification.
9. Money Back Guarantee
All products purchased on the SHIFTERS.CH website can be exchanged free of charge or refunded for a maximum period of 14 days after the date of purchase. The products must be returned at your own expense to: Shifters Lausanne, SAV Shifters, Avenue de France 1, 1004 Lausanne (reimbursement of shipping costs by credit voucher up to CHF9.00 depending on the material. Return costs concerning an order error on the part of the buyer cannot be reimbursed) , and a return form must reach us during this same legal deadline (14 days after the purchase date).
10. Warranty
In the event of delivery of a defective product, SHIFTERS.CH products benefit from a guarantee as follows:
SHIFTERS.CH products, including and limited to: battery, USB charger, USB cable, wall adapter, charging case are under warranty for a period of 3 months after the date of purchase. This excludes natural alteration due to use of the product. Defective products will either be repaired or exchanged.
Cartridges, atomizers and cartomizers are consumable parts and therefore do not benefit from any warranty.
11. Delivery conditions
Delivery is FREE from CHF50 and without customs fees!
For all orders below CHF50, transport costs are the responsibility of the buyer up to a fixed amount of 8 CHF/6.50€.
The products will be delivered within a maximum of 24 working hours if the order is valid before 11 a.m. on the day of dispatch, and if there is no slowdown by the Swiss Post. Average delivery time: 24/48 hours
Important:
Delivery of the products remains the responsibility of the buyer. We entrust orders to Swiss Post. You will be sent a tracking number. We recommend that you contact Swiss Post to check that your package is being delivered and to investigate the causes of a possible problem occurring during delivery. If Swiss Post is unable to deliver the order to the address you have provided to us, it is your responsibility to go to the distribution center to collect your order, or to call Swiss Post to re -route the delivery to the address of your choice.
12. Using your product
By reading this document, you agree to take full responsibility for the use you make of the product ordered on SHIFTERS.CH. Some e-liquids sold on the SHIFTERS.CH website contain nicotine, and all contain propylene glycol, vegetable glycerin as well as food flavorings. It is strongly recommended to consult your doctor before using e-liquids sold on SHIFTERS.CH.
The effects of nicotine can be stimulation, a feeling of relaxation, calm or alertness. The carcinogenic properties of nicotine, separated from inhalation via tobacco, have not yet been evaluated by the International Agency for Research on Cancer.
Electronic cigarette batteries can cause electric shocks and inhaling e-liquid vapor can cause suffocation in some cases. If you have any problems, consult your doctor immediately.
All SHIFTERS.CH products without exception must be kept out of the reach of children.
SHIFTERS.CH cannot be held responsible in the event of injury, loss or allergic reaction which may occur following the use of its products.
13. Liability
For all stages of accessing the site, consulting, filling out forms, placing an order, delivering items or any other service, the company SHIFTERS Lausanne Sàrl only has an obligation of means.
Consequently, SHIFTERS.CH cannot be held liable for any inconveniences or damages inherent to the use of the Internet network and totally external to the diligence and precautions taken by SHIFTERS.CH. In particular, any disruption in the provision of the service, or any external intrusion or presence of computer virus, cannot engage the responsibility of SHIFTERS.CH.
Likewise, any event qualified as force majeure within the meaning of the case law of the Court of Cassation completely exonerates SHIFTERS.CH from any liability.
14. Intellectual property
All elements of the SHIFTERS.CH site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of SHIFTERS.CH Any hypertext link referring to the SHIFTERS.CH site and using in particular the technique of framing, deep-linking, in-line linking or any other deep link technique is in any event strictly forbidden.
In all cases, any link, even tacitly authorized, must be removed upon simple request from SHIFTERS.CH
15. Personal data
SHIFTERS.CH, for the purposes of the service, reserves the right to collect personal data relating to users of the site, in particular by means of “cookies” referred to in article 8. SHIFTERS.CH also reserves the right to commercially transfer the data it has collected on its site.
In all cases, and in accordance with law n°78-17 of January 6, 1978, any user or customer of the site may at any time oppose the commercial use of said data and also benefits from a right of access, rectification and deletion of data concerning him.
